Introduction

Welcome to Storytiles, the online service that allows you to turn your cherished photos and memories into framed prints, referred to as “tiles”. Please read these Terms of Use (“Terms”) carefully before using the Storytiles website (“the Service”) operated by us. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms.

Account Registration

To use our service, you may be required to register an account. You must provide accurate and complete information and keep your account information updated. You are responsible for safeguarding your account, and you agree that you will be solely responsible for any activities or actions taken under your account.

Content and Copyright

When you upload or otherwise submit content to our service, you retain ownership of any intellectual property rights that you hold in that content. However, by uploading content, you grant us the use of your photos in order to print them

We reserve the right to refuse to accept, post, display, or transmit any User Content in our sole discretion.

You represent and warrant that: (i) the content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your content on or through the service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Purchases and Payments

All orders made through the service are subject to acceptance by us. We may refuse to accept or may cancel any order, whether or not the order has been confirmed, for any or no reason, and without liability to you or anyone else.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time.

We accept various forms of payment, as noted on our service. You agree to comply with the terms and conditions of any applicable agreement(s) governing the payment method you choose.

Production and Shipping

Once your order is confirmed and payment is received, Storytiles will facilitate the production of your tiles with a 3rd party printing facility. We take utmost care in ensuring the quality of the product and aim to dispatch the product for shipping as soon as possible. However, shipping times are estimates and not guaranteed, as shipments may be affected by weather-related delays or events outside of our control.

Returns and Refunds

Please refer to our Return and Refund policy, which is incorporated into these Terms by reference, for information on returning products purchased through the service.

Limitation of Liability

In no event shall Storytiles, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Western Cape, South Africa, without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
